1️⃣ Scope and acceptance

These Terms apply to the use of zeltasiers.lv and to orders placed through our online store.

By placing an order, you confirm that you have had the opportunity to read these Terms and that you agree to the conditions applicable to your purchase.

Information about how we process personal data is provided separately in our Privacy Policy.

If you do not agree with these Terms, please do not place an order through our online store.

2️⃣ Use of the website

You may use our website only for lawful purposes and in a manner that does not interfere with the proper operation of the website or infringe the rights of others.

We may restrict access to the website or our services where we reasonably suspect fraud, misuse, unlawful activity, security risks or abuse.

We aim to keep the website available and accurate, but temporary interruptions, maintenance or technical errors may occasionally occur.

3️⃣ Products, prices and hand-cut cheese

All prices are shown in EUR and include VAT where applicable, unless clearly stated otherwise.

The price applicable to an order is the price displayed during checkout before the order is submitted.

We may update prices, product ranges and product information at any time. Such changes do not affect orders for which a distance contract has already been concluded, except where required by law or agreed with the customer.

We reserve the right to correct obvious pricing, product information or technical errors.

Product photographs are intended to provide a realistic representation of our products. Natural products such as cheese may nevertheless vary slightly in colour, rind, texture, shape and appearance.

Hand-cut cheese portions

Certain cheeses are cut and prepared by hand. Weight options such as 250 g, 350 g, 500 g, 750 g and 1000 g are therefore approximate target weights unless the relevant product page expressly states otherwise.

Because every piece is cut by hand, small weight differences are unavoidable. We always aim to cut fairly and as accurately as reasonably possible.

Unless otherwise stated on the product page, the following maximum guideline variations apply:

  • 250 g portion: up to 25 g variation
  • 350 g portion: up to 35 g variation
  • 500 g portion: up to 50 g variation
  • 750 g portion: up to 75 g variation
  • 1000 g portion: up to 100 g variation

Where multiple portions of the same cheese and weight category are ordered, individual pieces may differ in weight. The overall quantity may be assessed together, taking the applicable hand-cut tolerances into account.

For example, when two 250 g portions are ordered, one piece may weigh slightly more and the other slightly less than 250 g.

These reasonable hand-cut variations do not limit your statutory rights where a product is materially incorrect, defective, unsafe or otherwise not in conformity with the contract.

4️⃣ Orders, contract conclusion and payment

When placing an order, you are responsible for providing accurate and complete information, including your contact details and delivery information.

Payment

Available payment methods are displayed during checkout. Payment by debit or credit card is available where shown at checkout and is processed through the payment service provider made available for the transaction.

By completing the checkout and activating the final order or payment button, you acknowledge that the order involves an obligation to pay.

Payment must be successfully authorised using the selected payment method before the order can be completed, unless another payment arrangement is expressly offered at checkout.

When is the contract concluded?

After your order has been successfully submitted and, where applicable, payment has been authorised, we will send an order confirmation to the email address provided during checkout.

The distance contract between you and SIA "Zelta produkti" is concluded when we send the order confirmation email.

We may subsequently cancel an order where fulfilment is objectively impossible or inappropriate, for example because of an obvious pricing or technical error, incorrect stock information, suspected fraud or another legitimate reason.

If we cancel an order after payment has already been received, the applicable amount will be refunded to the original payment method without undue delay.

Card payments are processed by third-party payment service providers. Zelta Siers does not receive or store the complete payment card details entered during the payment process.

5️⃣ Shipping and delivery

Available delivery methods and applicable delivery charges are displayed during checkout before the order is placed.

Detailed information about shipping methods, costs, order processing, estimated delivery times and parcel collection is available in our:

Delivery times stated on our website are estimates unless expressly stated otherwise. Delivery may be affected by courier operations, public holidays, weather conditions, unusually high parcel volumes or other circumstances outside our reasonable control.

Where a delivery problem occurs, please contact us so that we can investigate the shipment with the relevant carrier.

Nothing in this section limits any statutory rights or remedies you may have in relation to delivery of your order.

6️⃣ Returns, withdrawal and refunds

Detailed rules regarding withdrawals, returns, complaints and refunds are available in our:

Consumers generally have a 14-day right of withdrawal for eligible goods purchased at a distance.

Legal exceptions apply. In particular, the standard right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly, including applicable perishable food products.

This does not affect statutory rights where goods are incorrect, damaged, defective, unsafe or otherwise not in conformity with the contract.

7️⃣ Food safety and storage

Many of our products are food products that require suitable storage conditions.

After the products have been delivered to you or collected by you from a parcel machine, collection point or our store, you are responsible for storing and handling them appropriately.

Perishable products should be collected without unnecessary delay and refrigerated where required.

Deterioration caused by delayed collection, failure to refrigerate, exposure to unsuitable temperatures or improper storage or handling after delivery or collection may affect the customer's entitlement to a remedy where the problem was caused by those circumstances.

This does not limit statutory rights relating to problems that already existed when the goods were delivered.

8️⃣ Complaints and dispute resolution

If you have a complaint about an order, product or our service, please contact us first so that we can try to resolve the matter directly.

📧 info@zeltasiers.lv
📞 +371 25 537 987

Please provide enough information for us to identify the order and understand the problem and the solution you are requesting.

We will respond to a written consumer complaint within 15 working days of receiving it, unless objective circumstances require additional time. Where additional time is necessary, we will inform you accordingly.

If we cannot resolve the dispute directly, consumers may contact the Latvian Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs — PTAC) for assistance.

Where applicable, a dispute may subsequently be submitted to the Consumer Dispute Resolution Commission or another competent out-of-court dispute resolution body.

More information about consumer dispute resolution is available at www.ptac.gov.lv.

Your right to bring a claim before a competent court is not affected.

9️⃣ Privacy and data protection

We process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Information about what data we collect, why we process it, how long we retain it and your data protection rights is available in our:

🔟 Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

We are not liable for indirect or consequential losses to the extent that liability for such losses may lawfully be excluded.

We are not responsible for losses caused solely by circumstances outside our reasonable control where we have complied with our legal and contractual obligations.

Nothing in these Terms limits your mandatory consumer rights under Latvian or applicable EU consumer protection law.

1️⃣1️⃣ Governing law

These Terms and distance contracts concluded through our online store are governed by the laws of the Republic of Latvia.

Where you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under applicable law.

Disputes that cannot be resolved amicably or through an applicable out-of-court procedure may be submitted to a competent court in accordance with applicable law.

1️⃣2️⃣ Changes to these Terms

We may update these Terms from time to time to reflect changes in our business, services or applicable legal requirements.

The latest version will be published on this page together with the date of the most recent update.

Unless required by law or agreed with the customer, changes to these Terms do not retroactively alter the conditions of a distance contract that was already concluded before the changes took effect.
